Managing the Data Collision

New Jersey Legal is focused on managing the data collision between computer forensics and eDiscovery. Through our litigation consulting experience, New Jersey Legal has realized that while most computer forensics firms can collect data, they cannot deliver a usable database or proper load files used to create a database for any of the main software packages like Concordance or Summation. In one instance, a prominent NJ law firm had to run two databases simultaneous using Summation because the forensics firm used forensic tools to process and output the data. What the forensics firm considered a usable database was laughable... they felt that it was acceptable to produce a Summation database for all the electronic files (including emails) and another Summation database for the email attachments. So, if they got a search hit on the body of an email, they would have to remember the attachment name and then go to the "attachment database" and search for that attachment name so they could view the attachment. Currently, no forensic software is available that will allow you to output complete load files or a databases for Concordance, Summation or any of the other major litigation software. This is the collision! The other forensic firm felt that ediscovery was easy and "everybody is doing it, so why can't we". Well, currently you cannot use forensic software to perform thorough and complex ediscovery processing tasks. This is one of the reasons so many firms and their clients are getting sticker shock when the invoices are delivered. Make no mistake, both forensics and ediscovery require a lot of expertise and expense, but if done correctly and with the proper client expectation level there are far fewer surprises. New Jersey Legal owns and works with Summation and Concordance and we know how to provide load files and databases for either package as well as others.
